Terms & Conditions

These are the working Terms and Conditions of the Association of Counsellors & Psychotherapists, for now on referred to as ACPO.  They make a legal agreement between you, the client and ACPO. When you complete membership, a directory listing, your profile, or book an online course on ACPO’s website. ACPO reserves the right to revise and update these terms and conditions at any time without notice.  If you do not accept these terms and conditions in their entirety, you should not use ACPO’s services.  If you have any queries regarding these terms and conditions, please email your query to ContactACPO@protonmail.com  and ask for clarification. Throughout ACPO’s website and any additional information issued, care is/has been taken to describe and show the services offered as accurately as possible. Despite this, errors may occur. ACPO makes every effort to ensure that all information displayed on the website and in additional information is accurate; however, it accepts no liability for inaccuracies. Information below is placed alphabetically for ease of information access; this in no way indicates a hierarchy of importance.

  1. ACPO Membership – qualified therapist members are given an ACPO membership number, which they can display on personal advertising and websites. It must not be altered in any way, including size. It must display the membership number clearly. It must not be used if membership has been cancelled. Student members are not permitted to display/use ACPO membership details/logo under any circumstances.

  2. Blogs/articles – all ACPO blogs/articles are copyright-protected; ACPO is the owner of all intellectual property rights, all rights reserved. These works are protected by copyright laws and treaties around the world. We grant to you a worldwide, non-exclusive, royalty-free, revocable licence to view our blogs/articles on a computer or mobile device via a web browser. No part of any blog/article publication may be reproduced or transmitted in any form or by any means, electronic or mechanical, including photocopying, recording or any information storage and retrieval system known or to be invented, without the permission of the copyright owner, except by a member to copy and store this article in their web browser cache and to print as a personal copy for personal use only. All blogs/articles written by ACPO members and featured on ACPO’s website are the copyright of the author and should not be copied/used in any way without the express permission of the author in writing. The content of blogs/articles should not be taken as fact without verification and must never be used in place of qualified legal/medical professionals. ACPO accepts no responsibility for inaccuracies/misinformation in blogs/articles.

  3. Booking an Online Course – no course is deemed booked and placement reserved until payment has been made in full in accordance with the amount specified on ACPO’s website.

  4. Cancelled Membership – a cancelled membership/directory listing requires written notice for removal from the directory listing. If a member has cancelled membership, refunds will be divided by the months used and overpaid money transferred within 7 days to the bank details supplied. If ACPO has cancelled membership due to misuse/breach of these terms and conditions, no refund will be granted.

  5. Cancelled Online Course by students – course bookings can be cancelled and refunded in full if cancelled within 14 days of booking, unless the booking has been made within 14 days of the course start date, in which instance, where mitigating circumstances are claimed, refunds/deferred bookings are made at the sole discretion of ACPO.

  6. Cancelled Online Courses by ACPO – ACPO reserves the right to cancel an online course due to unforeseeable circumstances and circumstances beyond their control.

  7. Contact Details – ACPO will request suitable contact details from you. These details are essential to your membership/directory listing. ACPO cannot offer membership to therapists who withhold requested details.

  8. Copyright – We are the owner of all intellectual property rights on our website, and in the material published on it. All works are protected by copyright laws and treaties around the world. We grant to you a worldwide, non-exclusive, royalty-free, revocable licence to view our website and the material on it on a computer or mobile device via a web browser, to copy and store our website and the material on it in your web browser cache. You may not reproduce in any format (including on another website) any part of our website (including content, images, designs, look and feel) without our prior written consent. Other than the above, we do not grant you any other rights in relation to this website or the material on this website, and all other rights are reserved. For the avoidance of doubt, you must not adapt, edit, change, transform, publish, republish, distribute, redistribute, broadcast, rebroadcast, or show or play in public this website or the material on this website (in any form or media) without our prior written permission.  If you print off, reproduce, copy or download any part of our site in breach of this notice, your right to use our website will cease immediately and you must, at our option, return or destroy any copies of the materials you have made. We take the protection of our copyright very seriously. If we discover that you have breached the terms of the above licence, we may bring legal proceedings against you and seek monetary damages and/or an injunction to stop you using our materials. You could also be ordered to pay our legal costs. 

  9. Directory Listing – ACPO makes every effort to verify directory listings as accurate; it accepts no liability for accidental errors in directory listings. Within the bounds of decency/ethics, ACPO does not enforce restrictions on content on therapists/supervisors directory listings/profile page and will not seek to mediate disputed content between therapist/supervisor directory listings, enforcing only that one image per directory listing is accepted, and word count is up to 100 words.

  10. Governing Law & Jurisdiction -These terms and conditions shall be governed by and construed in accordance with English Law. Disputes arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the English courts, where the claim is brought by you, save where you have legal rights to bring any claim in respect of such a dispute in any other jurisdiction. ACPO retains the right to bring proceedings against you for any threatened or actual breach of these Terms and Conditions in your country of residence. ACPO does not warrant that therapy services or information for sale/available on this website are appropriate for use outside England. It is prohibited to access this website from territories where its contents are illegal or unlawful. If you access this website from locations outside England, you do so at your own risk, and you are responsible for compliance with local laws. If any provision of these terms and conditions is, for any reason, invalid and/or unenforceable as determined in an appropriate court of proper jurisdiction, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.  Users agree to replace an invalid/unenforceable provision with an enforceable provision that most closely approximates the intent and economic effect of the invalid/unenforceable provision and shall be interpreted most favourably, when possible, to the benefit of the company.

  11. Health & Safety – ACPO makes every effort to risk assess and provide a safe and secure website, membership areas, and online courses. If you experience/notice any health and safety risks, you are required to notify ACPO immediately so that risks raised can be addressed as necessary.

  12. Images – ACPO offers you the opportunity to upload images to your directory listing and profile page. All images must be copyright-free or images owned by you. Under no circumstances are images deemed to be obscene accepted or allowed.  Any breaches of copyright for an image featured are the liability of the individual submitting and using them; never ACPO.

  13. Limitation of Liability – the information, products, services, and other material included in, or available through ACPO’s website, may not be complete, may include errors or inaccuracies, and may be modified, discontinued, or deleted without notice. ACPO specifically disclaims any and all responsibility or liability for the accuracy, content, completeness, legality, reliability, or availability now or in the future.  Advice, information, and other materials supplied by ACPO, either downloaded from this site or obtained during emails, should not be relied upon for personal, medical, legal, business, financial or other decisions. ACPO disclaims any responsibility or liability for deletion, failure to store, misdelivery, viruses, loss of data, or untimely delivery of information or material through use of its website or any third-party links on it.  You access and use the services provided at your own discretion and risk.  No part of ACPO’s website is a substitute for professional legal/medical advice. When using this website, the user is solely responsible for any damage incurred to their computer system or data thereon.  ACPO disclaims any responsibility for any harm resulting from downloading or accessing any information or materials on the internet through its website.  Under no circumstance is ACPO liable for any delay or failure in performance resulting directly or indirectly from acts of nature, forces, or causes beyond there reasonable control – including without limitation, internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures, strikes, labour disputes, riots, insurrections, civil insurrections, civil disturbances, shortages of labour or material, fires, floods, storms, explosions, acts of god, war, government actions, order of domestic or foreign courts or tribunals, non-performance of 3rd parties, or loss of or fluctuation in heating, light, or air conditioning.

  14. Membership/Association Details – ACPO will request your membership number for BAPC, NCPS, or UKCP.  These details are essential to your membership/directory listing.  ACPO cannot accept therapists/students who withhold these details.

  15. Misleading Listings - ACPO makes every effort to verify directory listings as authentic and accurate; it accepts no liability for deliberately misleading information accepted and listed in good faith, but will remove listings immediately when made aware and verified. Removed listing refunds are at the discretion of ACPO.

  16. Online Acceptance – ACPO website users may not assign, sublicense, or otherwise transfer any rights under these Terms and Conditions.  If any provision of these Terms and Conditions is found by any court of competent jurisdiction to be invalid, the invalidity of the provision shall not affect the validity of the remaining provisions, which shall continue to have full force and effect.  No person other than the parties to these Terms and Conditions is intended to benefit from them, pursuant to ‘The Contracts (Rights of Third Parties) Act’ 1999. These terms represent the entire understanding between the User and the Company; they supersede any prior statements, representations or terms and conditions.

  17. Payment – All required payments are as stipulated on ACPO’s website, and are made via bank transfer to the bank details supplied. Membership and online course bookings are not complete until payment has been made in full. 

  18. Privacy Policy - Cookies are in use on ACPO’s website by its web host, Wix.com.  By using the website, you consent to the collection and use of your cookie information. Please see the full privacy policy document available on ACPO’s website.

  19. Refunds – accepted refunds will be completed within seven working days, with the provision of any necessary bank details.  Please refer to ‘Cancelled Membership’ and ‘Cancelled Online Course’ as above.

  20. Refusal –ACPO reserves the right to refuse membership/directory listing if, in its opinion, it is not suitable for the person/therapy practice concerned, is unethical, or would cause disruption to other users. In such circumstances, a full refund would be issued as per the refund policy.

  21. Resource Information – all resource information shared on ACPO’s website is shared in good faith. ACPO accepts no responsibility for third-party websites visited from its resource information.

  22. Suitability – information on ACPO’s website and within its online courses are designed using English law and legislation. ACPO as an association is not suitable for therapists in other countries. ACPO does not accept liability for anyone accessing its services from outside of English jurisdiction.

  23. Under 18 – ACPO does not offer any of its services, membership listings, or online courses to anyone under 18 years of age.

 

These terms and conditions do not affect your statutory rights.
